Legal & Policies

This page is the central index for the legal documents that govern Mareel Waters. It states who operates the service, explains what each document covers, and points you to the right place for the question you have.
This page is general information and not legal advice.
Who operates Mareel Waters
Mareel Waters is operated by LEGAL_ENTITY, based in Sweden (REGISTERED_ADDRESS, organisation number ORG_NUMBER, VAT number VAT_NUMBER). In these documents, "we", "us" and "our" mean LEGAL_ENTITY, and "you" means the Customer or other person using the service.
We provide a commercial, global tides REST API ("the API") delivered over the web at https://mareelearth.com, together with an administration surface at admin.mareelearth.com. Developers create an Account, generate an API Key, choose a Plan, and call the API to retrieve modelled tide values ("Output") for a given location and time.
These legal documents cover the API as it exists today. Some features are planned and not yet released:
- The tides API and our computed (non-official) tidal datums are live and generally available.
- A forecast and water-state API (waves, wind, sea-surface temperature, currents) is planned and not yet live.
- Native iOS and Android apps distributed through the Apple App Store and Google Play (together, "the Platform") are planned and not yet released.
Where a document contains clauses written for the forecast API or the apps, those clauses take effect only when, and to the extent that, the relevant product becomes available to you. Until then they describe how we intend those products to work, and the live tides API governs your current use.
What is and is not official
The Output is a set of modelled estimates. Our tidal datums, including HAT (Highest Astronomical Tide), LAT (Lowest Astronomical Tide) and any computed Chart Datum, are computed values and are not official unless a value is explicitly sourced from, and identified as coming from, a national hydrographic office. Real water levels can exceed HAT or fall below LAT under weather conditions such as storm surge, atmospheric pressure and wind. See the disclaimer below and the full text on the Attribution & Disclaimers page.
Document directory
The documents below form the agreement and policies between you and us. Read the Terms of Service first; the other documents are referenced by it and apply alongside it.
- [Terms of Service](/legal/terms) - The master agreement for using the API, your Account, your API Keys and your Plan. Covers acceptable use, billing through the Platform or our payment processor, the "as is" / no-warranty position, limitation of liability, the NOT FOR NAVIGATION restriction, and governing law (Sweden, courts of the courts of Sweden, with Stockholm District Court (Stockholms tingsratt) as court of first instance).
- [Privacy Policy](/legal/privacy) - What Personal Data we process, why, on what legal basis under the GDPR, how long we keep it, who we share it with, and your rights as a Data Subject. Explains that we use only strictly necessary authentication cookies and no tracking cookies, and that our web analytics are cookieless.
- [Acceptable Use Policy](/legal/acceptable-use) - The rules for how the API and Output may be used: prohibited content and activities, anti-abuse and rate-limit expectations, the ban on safety-of-life and navigation reliance, scraping and resale limits, and the consequences of breach.
- [Cookie Notice](/legal/cookies) - The cookies and similar technologies we use. In short: only strictly necessary authentication cookies to keep you logged in, a sessionStorage visitor identifier for cookieless analytics, and no third-party or advertising trackers. No consent banner is required because we set no non-essential cookies.
- [Subprocessors](/legal/subprocessors) - The current list of third parties that process Personal Data on our behalf: Stripe (payments), Resend (transactional email) and Cloudflare (CDN, edge, WAF, bot management and tunnel). The application itself is self-hosted on our own server. We use no third-party analytics processor.
- [Data Processing Agreement (DPA)](/legal/dpa) - For Customers who are Controllers and need a Processor agreement under Article 28 GDPR. Sets out our role as Processor, processing instructions, security commitments, Subprocessor terms, international-transfer mechanisms (Standard Contractual Clauses and, where applicable, the EU-US Data Privacy Framework), and audit and deletion duties.
- [Attribution & Disclaimers](/legal/attribution) - The legally required source credits for the data we use, including the FES2022 tide product via AVISO and the forecast and bathymetry sources we use or plan to use, together with the full NOT FOR NAVIGATION disclaimer and the licence-required notices for each source.
- [Account & Data Deletion](/legal/account-deletion) - How to delete your Account and associated data, both from the web and (when the apps ship) from within the app, what is deleted, what we must retain and for how long, and how to make a deletion request by URL. Provided to meet Apple App Store and Google Play deletion requirements.
- [End User Licence Agreement (EULA)](/legal/eula) - The licence that governs use of our mobile apps once released, including the Apple "Licensed Application" terms required for App Store distribution. The web API is governed by the Terms of Service rather than this EULA.
- [Imprint / Legal Notice](/legal/imprint) - The formal operator identification: legal name LEGAL_ENTITY, registered address REGISTERED_ADDRESS, organisation number ORG_NUMBER, VAT number VAT_NUMBER, and the responsible contact for legal correspondence.
NOT FOR NAVIGATION
The API, the Output, our tidal datums and any forecast values are modelled estimates provided "as is" and must not be used for navigation, safety-critical or life-critical decisions. They must not be your sole basis for safety of life at sea or any decision where error could cause harm. Real water levels can exceed the highest astronomical tide or fall below the lowest astronomical tide under weather conditions. Our datums are not official chart datum unless explicitly sourced from a hydrographic office. For the complete restriction and the consequences of relying on the service, read the full text on the Attribution & Disclaimers page.

Versioning and how changes are announced
Every legal document on this site carries a "Last updated" date. The date shown at the top of this index page reflects the most recent change to any of the linked documents; each individual document also carries its own date so you can see when that specific document last changed.
When we make material changes to these documents, we will update the relevant document and its "Last updated" date, refresh this index, and, where the change materially affects your rights or obligations, give reasonable advance notice by posting a notice in the developer portal and updating the document's "Last updated" date before the change takes effect, and, where we hold a current email address for you and the change materially affects your rights, we may also notify you by email. Non-material changes, such as clarifications, corrections and updates to the Subprocessors list, take effect when published, though we will still record them by changing the document's date. Continuing to use the API after a change takes effect means you accept the updated terms; if you do not agree, you should stop using the API and may close your Account as described in Account & Data Deletion.
We keep the current version of each document available at its stable URL above. If you need a copy of a previous version for your records, contact [email protected].
